These Terms & Conditions (“Terms”) govern your use of Transparent Freight Service (“TFS”, “we”, “us”) and the freight forwarding, customs brokerage, warehousing, and related logistics services we provide. By submitting a quotation request, accepting a quotation, or instructing us to handle your cargo, you agree to be bound by these Terms.
1. Acceptance of Terms
By using our website, requesting a quote, or engaging us to perform any service, you confirm that you have read, understood and accepted these Terms. If you do not agree, please do not use our services.
2. Quotation Validity
Quotations are valid for the period stated on the quotation document, typically 14 days from issue, and remain subject to space and equipment availability at time of booking. Rates may be revised due to changes in carrier surcharges, fuel adjustments, currency fluctuations, or unforeseen events outside our reasonable control.
3. Scope of Services
We act as a freight forwarder and not as a carrier unless expressly stated. We arrange transport, customs clearance, warehousing and related services with reputable third-party providers in our own name on your behalf, and our liability is limited as set out in these Terms.
4. Liability
Unless agreed otherwise in writing, our liability is governed by the FIATA Model Rules for Freight Forwarding Services and capped at 2 SDR per kilogram of gross weight of cargo lost or damaged, or USD 10,000 per incident, whichever is lower. We are not liable for indirect, consequential, or special losses including loss of profits, market or use.
5. Cargo Handling Responsibility
You warrant that all cargo descriptions, weights, dimensions, HS codes and dangerous-goods declarations supplied to us are accurate and complete. You are responsible for ensuring that cargo is properly packed, marked and labelled for the mode of transport, and that any necessary permits or licences have been obtained.
6. Insurance
Cargo is not insured unless you specifically request marine, air or all-risk cargo insurance and we confirm cover in writing. We strongly recommend customers arrange adequate insurance to cover the full commercial value of their goods plus freight and duties.
7. Payment Terms
Unless agreed otherwise, charges are payable in advance for prepaid shipments and within 15 days of invoice date for credit accounts. Late payments may incur interest at 1.5% per month. Cargo, documents and proceeds are subject to a general lien for any unpaid amounts due to us.
8. Force Majeure
We are not liable for delays or failure to perform caused by events outside our reasonable control, including acts of God, war, civil unrest, strikes, port congestion, customs hold-ups, pandemics, weather events, regulatory action or carrier failure.
9. Restricted & Prohibited Cargo
You must not tender cargo that is illegal under the laws of the country of origin, transit or destination. Dangerous goods, perishables, live animals, weapons, currency and other restricted commodities require prior written agreement and full IMO/IATA documentation.
10. Governing Law & Jurisdiction
These Terms are governed by the laws of the Islamic Republic of Pakistan. Any dispute arising from or in connection with our services shall be submitted to the exclusive jurisdiction of the courts of Karachi, Pakistan, unless we elect otherwise.
11. Changes to These Terms
We may update these Terms from time to time. The version in force is the one published on this page on the date of your booking or quotation acceptance.
